Terms of Use (GTC) of Tavel GmbH

1. Scope and Provider

These Terms of Use govern the use of the mobile application „Tavel“ (hereinafter referred to as „App“) provided by:

By using the App, the user agrees to these terms and conditions.

2. Purpose of the App

The „Tavel“ App is designed to support individuals who wish to work or live in Germany with the necessary administrative steps.
This includes, in particular:

  • Registration and user account management
  • Uploading and management of personal documents (e.g., visas, passports, salary statements)
  • Language learning functions
  • Brokerage of insurance, bank accounts, and other services
  • Support with authorities and application procedures

The App is operated by Tavel GmbH and offered via Android and iOS app stores.

3. Registration and User Account

  1. Use of the App requires registration. Users must be at least 18 years old.
  2. Registration takes place via email or mobile phone number.
  3. Each user may maintain only one personal account.
  4. The user account can be deleted via the App at any time. Upon deletion, stored data will be removed in accordance with data protection regulations.

4. Services and Brokerage

  1. Tavel offers its own digital services (e.g., document management, language learning modules) as well as the brokerage of external services (e.g., insurance, banks, contact with authorities).
  2. In these cases, Tavel merely acts as an intermediary between the user and the partner. A contractual relationship regarding the respective service is established directly between the user and the partner company.
  3. Tavel assumes no liability or warranty for the content, execution, or quality of these partner services.
  4. There is no guarantee of success—particularly regarding visas, residency permits, or official procedures.

5. Data Storage and Data Protection

  1. Tavel stores personal data and documents of users (e.g., passport, visa, tax ID, salary statement, birth certificate) on servers in Germany.
  2. Data transmission is encrypted via HTTPS.
  3. Only authorized employees of Tavel GmbH have access to the data.
  4. Storage continues until the account is deleted or consent is revoked.
  5. Further details on data processing are regulated in the Privacy Policy.

6. Transfer to Third Parties

  1. To provide certain services, Tavel may transfer personal data to carefully selected partners (e.g., banks, insurance companies, authorities, language schools).
  2. Transfer only takes place with the user’s express consent.
  3. Only the information required for the respective service (e.g., documents, address, contact details) is transmitted.
  4. Data Processing Agreements (DPA) pursuant to Art. 28 GDPR exist with all partners.

7. Costs and Payment Processing

  1. The use of the App is generally free of charge.
  2. Individual additional services may be offered as in-app purchases. These will be clearly marked in advance.
  3. insofar as paid services are utilized, the price indications in the respective in-app purchase apply.
  4. The statutory right of withdrawal according to § 355 BGB (German Civil Code) remains unaffected.

8. Liability

  1. Tavel is liable without limitation for damages based on intent or gross negligence.
  2. For simple negligence, Tavel is only liable for the breach of essential contractual obligations (cardinal duties), limited to the damage foreseeable and typical for the contract.
  3. Liability for third-party services (partner companies) is excluded.
  4. Tavel assumes no guarantee of success for official procedures, visa applications, or brokered services.
  5. The App does not replace legal or official advice.

9. Intellectual Property

All contents of the App (texts, designs, logos, software code, etc.) are protected by copyright. Any reproduction, modification, or further use is only permitted with the written consent of Tavel GmbH.

10. Termination and Deletion

The user can delete their account independently in the App at any time.
After deletion, personal data will be deleted in accordance with the Privacy Policy, provided no statutory retention obligation exists.

11. Communication and Notifications

  1. Users can contact Tavel via email (contact@tavel.app) or WhatsApp.
  2. Tavel may inform users via push notifications or email about relevant changes, updates, or services.
  3. Advertising content or marketing offers may be displayed in the App.

12. Amendments to the Terms of Use

Tavel reserves the right to amend these Terms of Use insofar as this is necessary for factual reasons (e.g., legal adjustments, expansion of App functions).
Amendments will be communicated to the user in good time. If the user does not object within 14 days, the amendments are deemed accepted.

13. User-Generated Content (UGC)

13.1 General

The App allows users to upload certain content, in particular:

  • Profile pictures
  • Personal information in the profile (e.g., „About Me“ texts)
  • Other content approved by Tavel

By uploading content, the user agrees to these provisions.

13.2 Responsibility of the User

The user is solely responsible for the content uploaded by them. The user warrants that:

  • They possess all necessary rights to the content
  • The content does not violate the rights of third parties (in particular copyright, trademark, or personal rights)
  • The content does not violate statutory regulations

13.3 Prohibited Content

The following content is expressly prohibited and leads to the immediate suspension or deletion of the account:

  1. Illegal Content: Content that violates German or international law
  2. Depictions of Violence: Depictions of violence, terrorism, or extremist ideologies
  3. Pornographic or Sexually Explicit Content: Nudity, sexual acts, or suggestive depictions
  4. Hate Speech and Discrimination: Content that calls for hate, violence, or discrimination based on race, ethnic origin, religion, gender, sexual orientation, disability, or nationality
  5. Harassment and Bullying: Content that insults, threatens, or harasses other persons
  6. False Identity: Use of images of other persons or fake profiles
  7. Endangerment of Children or Youth: Any content that endangers or exploits minors
  8. Fraud and Misleading Information: Content serving deception or fraudulent purposes
  9. Spam and Commercial Content: Unsolicited advertising, sales offers, or spam
  10. Protection of Third Parties: Photos or information about third parties without their consent

13.4 Moderation and Control

  1. Tavel reserves the right to check, edit, or remove uploaded content at any time.
  2. The check can be carried out both automatically (through technical filters) and manually (by employees).
  3. Tavel is not obliged to proactively monitor all content but acts immediately upon indication of legal violations.
  4. Users can report inappropriate content of other users (see 13.6).

13.5 Legal Basis

Moderation is carried out in accordance with:

  • NetzDG (Network Enforcement Act): Handling of illegal content
  • TMG § 10 (Telemedia Act): Liability privilege as a host provider
  • GDPR Art. 6 (1) lit. f: Legitimate interest in a legally compliant platform
  • Apple App Store Review Guidelines 1.2 and 5.1: Requirements for user-generated content
  • Google Play Developer Policy: Guidelines on user-generated content

13.6 Reporting and Complaint Procedure

  1. Users can report inappropriate or illegal content via:
    • Email: contact@tavel.app
    • Subject: „Report Content“ stating the affected user and description
  2. Tavel checks all reports immediately and acts within 24 hours (in case of obviously illegal content) or 7 days (in more complex cases).
  3. The reporting user receives feedback on the result of the review.

13.7 Sanctions

In case of violations of these provisions, Tavel may take the following measures:

  1. Warning the user
  2. Removal of the affected content
  3. Temporary suspension of the account (3-30 days)
  4. Permanent deletion of the account
  5. Reporting to law enforcement authorities (in case of serious violations)

The choice of measure lies at the discretion of Tavel and depends on the severity of the violation.

13.8 Granting of Rights

By uploading content, the user grants Tavel a simple, non-exclusive, worldwide right of use insofar as this is necessary for the provision of the service (e.g., display of the profile picture in the App, technical storage on servers).

This granting of rights ends with the deletion of the content or the account.

13.9 Disclaimer

  1. Tavel assumes no liability for content uploaded by users.
  2. Users are liable themselves for legal violations against third parties.
  3. Users indemnify Tavel against claims by third parties resulting from illegal content of the user.

14. Final Provisions

  1. German law applies to the exclusion of the UN Sales Convention.
  2. The place of jurisdiction is Deggendorf, Germany.
  3. Should individual provisions of these Terms of Use be ineffective, the validity of the remaining provisions remains unaffected.
